These Terms of Service ("Terms") govern your access to and use of the StackifyX website and platform (the "Service"), operated by StackifyX ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
StackifyX provides website, web application, mobile application, custom software, e-commerce and related digital product development services, along with a platform for clients to submit project inquiries, communicate with our team, and track project progress.
By creating an account, submitting a project inquiry, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
StackifyX offers custom software development services on a project-by-project basis, including but not limited to web development, mobile app development, custom software, e-commerce platforms, API integrations, and related consulting. The specific scope, deliverables, timeline and cost of any individual project are agreed separately between StackifyX and the client before work begins, and these Terms do not by themselves constitute a project agreement.
When you submit a project inquiry or contact form, you provide details about your intended project so our team can evaluate it and respond. Submitting an inquiry does not guarantee that StackifyX will accept or undertake the project. Communication regarding active projects may take place through the platform's messaging feature, email, or other channels agreed with our team.
Project scope, requirements, timelines and deliverables will be discussed and confirmed with each client individually. Changes to scope after work has begun may affect timeline and cost, and will be discussed with you before being implemented.
Where payments are collected through the platform, they are processed via a third-party payment processor. StackifyX does not store your full payment card details on its own servers. Fees, payment schedules and refund terms (if any) for a specific project are agreed with the client as part of that project and are not fixed by these general Terms.
Unless otherwise agreed in writing for a specific project, existing StackifyX tools, frameworks, internal code libraries and pre-existing materials remain the property of StackifyX. Ownership of custom deliverables created specifically for a client project is determined by the agreement for that project. Content on the public StackifyX website (text, design, branding) may not be copied or reused without permission.
You retain ownership of any content, materials, files or information you upload or provide to us (such as project descriptions, documents, or reference files). By providing this content, you grant StackifyX a license to use it solely for the purpose of evaluating and delivering your project. You are responsible for ensuring you have the right to share any content or materials you provide.
The Service may rely on third-party providers for functionality such as authentication (e.g. Google Sign-In), email delivery, payment processing, and hosting infrastructure. Your use of those features may also be subject to the respective third party's own terms and privacy practices.
We treat project details, business information and materials shared with us in connection with a project as confidential, and we expect clients to treat any non-public information we share about our internal processes similarly. Specific confidentiality obligations for a project may be further defined in a separate project agreement.

Either party may raise a request to cancel or pause an active project; the effect of cancellation on already-completed work, fees paid, and remaining deliverables will depend on the specific project agreement. We may suspend or terminate access to the Service for accounts that violate these Terms.
The Service and its content are provided "as is" and "as available." To the fullest extent permitted by law, StackifyX disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by applicable law, StackifyX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service, even if advised of the possibility of such damages.
You agree to indemnify and hold StackifyX harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may update these Terms from time to time to reflect changes to our Service or for legal or operational reasons. When we do, we will update the "Last Updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
